7. Data Security

We implement appropriate technical and organizational measures to protect your data, including: 256-bit SSL encryption, access controls, regular security audits, and staff training on data protection.

8. Retention Period

We retain your personal information for as long as necessary to fulfill the purposes outlined in this policy, or as required by law (typically 5 years after account closure per NCA requirements).

1. Definitions

"NCA" means the National Credit Act 34 of 2005. "NCR" means the National Credit Regulator. "Credit Agreement" means the agreement entered into between us and you for the provision of credit.

2. Eligibility

To apply for credit, you must:

• Be a South African citizen or permanent resident
• Be at least 18 years of age
• Have a valid South African ID
• Have a regular source of income
• Have an active South African bank account
• Pass our affordability assessment

3. Credit Assessment

In terms of Section 81 of the NCA, we are required to conduct an affordability assessment before granting credit. This includes verifying your income, expenses, and existing credit obligations. We reserve the right to decline any application that does not meet our lending criteria.

4. Interest and Fees

All interest and fees are regulated by the NCA:

• Maximum Interest Rate: Repo Rate × 2.2 + 20% per annum (currently 30%)
• Initiation Fee: R165 per credit agreement (VAT incl.)
• Monthly Service Fee: R69 (VAT incl.)
• Default Administration Fee: As per NCA regulations

5. Repayment

You agree to repay the loan according to the repayment schedule provided in your credit agreement. Payments will be collected via debit order on the agreed dates. Early settlement is permitted without penalty.

6. Default and Debt Collection

If you fail to make payments, we may: (a) Charge default fees as permitted by the NCA; (b) Report the default to credit bureaus; (c) Initiate legal proceedings to recover the debt; (d) Hand over to registered debt collectors.

7. Cooling-Off Period

In terms of Section 121 of the NCA, you may cancel the credit agreement within 5 business days without penalty by providing written notice and repaying the principal amount.

9. Governing Law
